Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and FunnelCanary. By accessing or using funnelcanary.com or any FunnelCanary scan, account, report, checkout, or monitoring feature (collectively, the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and authority
You must be at least 18 and able to form a binding contract. If you use the Service for a company or another person, you represent that you have authority to bind them, and “you” includes that organization.
2. The Service
FunnelCanary automatically reviews signals available from publicly reachable web pages, including links, forms, redirects, tracking tags, price references, and trust or legal links. Paid plans may save funnels and run scheduled scans. Features, scan depth, frequency, and supported signals may change as the Service evolves.
3. Accounts and security
Accounts use Google authentication. You are responsible for your Google account security, all activity under your FunnelCanary session, and promptly notifying us of suspected unauthorized access. You must provide accurate information and may not impersonate anyone or share access in a way that defeats plan limits.
4. Authorized use
You may scan or monitor only websites, funnels, and systems you own or have express authority to test. You may not use the Service to access private systems; bypass authentication, CAPTCHAs, robots controls, or technical restrictions; discover or exploit vulnerabilities; collect personal information unlawfully; overload or disrupt a site; infringe rights; violate law; resell the Service without permission; reverse engineer the Service except where law expressly permits; or help another person do any of these things.
5. Your responsibilities
You remain solely responsible for your funnels, websites, ads, offers, payments, fulfillment, claims, legal compliance, accessibility, data practices, customer support, and business decisions. You must independently and manually test critical buyer paths, including opt-ins, checkout, payment, order confirmation, product delivery, email delivery, upsells, downsells, decline paths, refunds, analytics events, mobile behavior, and third-party automations.
6. Automated reports and monitoring limitations
Reports are automated, limited to the pages and signals the Service can reach at the time of a scan, and are advisory only. Reports may be incomplete, delayed, unavailable, inaccurate, or contain false positives or false negatives. Bot protection, personalization, geography, cookies, login state, scripts, browser differences, device differences, third-party services, and changes made after a scan can affect results. A healthy score does not mean a funnel is error-free, compliant, profitable, or ready for traffic. A warning does not prove a defect.
FunnelCanary does not guarantee that it will detect, prevent, or notify you of any funnel failure, lost lead, broken checkout, tracking error, payment issue, delivery failure, outage, or other problem. You must not rely on FunnelCanary as your only testing, monitoring, quality-assurance, legal-compliance, or business-continuity system.
7. Subscriptions, automatic renewal, and cancellation
FunnelCanary Pro is offered at the price and billing interval displayed at checkout. The monthly plan automatically renews each month, and the annual plan automatically renews each year, until canceled. By purchasing, you authorize Stripe and FunnelCanary to charge the payment method on file for recurring fees, applicable taxes, and any clearly disclosed charges.
You may cancel future renewal by emailing hey@funnelcanary.com. Submit cancellation requests at least three business days before the renewal date to allow processing. Cancellation stops future renewals and does not ordinarily refund the current billing period. Your access may continue through the paid period unless law requires otherwise.
8. 14-day Clear Air Guarantee
A first-time Pro customer may request a refund of the initial subscription charge within 14 calendar days after purchase by emailing hey@funnelcanary.com from the purchase email. The guarantee does not apply to renewal charges, prior customers, repeated or abusive requests, chargeback fraud, material violations of these Terms, or amounts that cannot lawfully be refunded. Nothing here limits non-waivable consumer rights.
9. Third-party services
The Service interoperates with or links to third parties, including Google, Stripe, hosting providers, page builders, advertising platforms, analytics tools, and websites you scan. We do not control and are not responsible for third-party availability, content, security, policies, acts, or omissions. Your use of third-party services is governed by their terms.
10. Ownership and feedback
FunnelCanary and its software, design, branding, documentation, and report format are owned by FunnelCanary or its licensors and are protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your internal business purposes. You retain your rights in your URLs, sites, and submitted content. You grant us the limited rights needed to access public pages and process submitted information to provide and improve the Service. Feedback may be used without restriction or compensation.
11. Service changes, suspension, and termination
We may modify, suspend, limit, or discontinue all or part of the Service; impose reasonable usage limits; or suspend or terminate access for nonpayment, security risk, abuse, legal requirements, or violation of these Terms. Where practical, we will provide notice of a material discontinuation of paid service. You may stop using the Service at any time.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FUNNELCANARY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, CURRENT, COMPLETE, OR THAT ANY ISSUE WILL BE FOUND, REPORTED, OR CORRECTED.
13. No earnings or business-results promise
FunnelCanary is a technical monitoring tool, not a business opportunity, investment, or income system. We make no promise or representation that using the Service will produce sales, leads, conversions, profit, revenue, advertising approval, lower costs, or any other business result. Any examples, illustrations, scores, scenarios, or references to avoided loss are explanatory only and are not earnings claims, guarantees, or representations of typical results. Results depend on factors outside our control.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNNELCANARY AND ITS OWNERS, AFFILIATES, PROVIDERS, CONTRACTORS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST SALES, LEADS, TRAFFIC, REVENUE, PROFITS, SAVINGS, GOODWILL, OPPORTUNITY, OR DATA; ADVERTISING SPEND; REFUNDS OR CHARGEBACKS; CUSTOMER CLAIMS; BUSINESS INTERRUPTION; FUNNEL OR CHECKOUT FAILURE; FAILURE TO DETECT OR REPORT A PROBLEM; OR THE COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED THAT SUCH HARM WAS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF US$100 OR THE FEES YOU PAID TO FUNNELCANARY DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless FunnelCanary and its owners, affiliates, providers, contractors, and personnel from third-party claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable legal fees arising from your funnels or offers, submitted URLs or content, unauthorized or unlawful scans, breach of these Terms, violation of law, or infringement of another person’s rights.
16. General terms
These Terms, the Privacy Policy, and checkout terms are the entire agreement about the Service and replace prior discussions on that subject. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, financing, merger, or sale. Headings are for convenience only. Provisions that by their nature should survive termination will survive.
17. Changes and contact
We may update these Terms. We will post the new version with a revised effective date and provide additional notice when required. Continued use after the effective date constitutes acceptance where permitted by law. Questions, cancellations, and refund requests may be sent to hey@funnelcanary.com.
